Raffle 2019 - Terms and Conditions

Thank you for supporting the Upon This Rock campaign of St. Peter Catholic Church (the “Raffle”), conducted by St. Peter Catholic Church. Your purchase of one or more raffle ticket(s) signifies your full and unconditional agreement to the following Terms & Conditions. In the event of any dispute, a reasonable interpretation or determination by St. Peter Catholic Church, with approval from the Colorado Secretary of State, regarding the application of these Terms & Conditions is final and binding in all matters related to the Raffle.
VOID WHERE PROHIBITED BY LAW AND OUTSIDE THE UNITED STATES. Subject to all applicable federal, state, and local laws, regulations, and ordinances. Tickets may sell out before the date of the raffle drawing. The chances of winning are based on the number of tickets sold. If fewer tickets are sold, the chances of winning the prize improves.

Each winner hereby releases and holds St. Peter Catholic Church harmless with respect to any claim based on any such occurrence. A raffle entrant’s sole and exclusive remedy for any breach of duty or conduct related to the Raffle shall be limited to the return of the purchase price paid for his or her raffle tickets. In no event shall St. Peter Catholic Church be liable to any person for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or, consequential, or other damages of any person or entity whether arising in contract, tort or otherwise, arising out of the Giveaway, use or ownership of the prizes.
General Conditions
If, for any reason, the Raffle is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of St. Peter Catholic Church which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Raffle, St. Peter Catholic Church may, upon approval from the Colorado Secretary of State, void any suspect entries and (a) cancel or terminate the Raffle (or any portion thereof); (b) modify the Raffle or suspend the Raffle to address the impairment and then resume the Raffle in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible, non-suspect entries received up to the time of impairment, and all eligible entries received.

Eligibility
- To be eligible to purchase a ticket, you must be at least 18 years old and a living resident of the United States.
- A ticket purchased by an ineligible person is void, and cannot be a winning ticket. No refunds will be made to ineligible purchasers.
- Winning a prize is contingent upon fulfilling all requirements set forth herein. St. Peter Catholic Church reserves the right to verify the eligibility of winners.

Tickets
- Tickets may be reserved online at petertherock.org/raffle, by direct sale from a St. Peter representative or at St. Peter Catholic Church (55 Jefferson, Monument, CO) during regular business hours (M-F, 8:30am-noon, 1-4:30pm). You must provide all required information to be eligible to enter and win. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified.
- Tickets may be reserved for $25 each. Tickets purchased online are subject to applicable fees.
- A ticket represents a chance to win the opportunity to accept an offer of the stated prize. All sales of tickets are final, and no refunds will be paid.
- Tickets, prizes, receipts, and any winner’s rights are not transferable.
- St. Peter Catholic Church reserves the right to reject any ticket reservation request that is submitted with payment that does not constitute “good funds”. A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was “declined,” or reported as “invalid” or “stolen” is void, and cannot be a winning ticket.
- The IRS has ruled that a payment for a raffle ticket is a tax-deductible charitable contribution only to the extent the amount of the payment exceeds the price of the ticket.
- All ticket purchase requests must be received and/or purchased by the indicated deadline. All defective or physically altered tickets or entry forms may be disqualified.
- Ticket refunds will not be issued after a ticket has been purchased.
Online Ticket Sales
- Tickets purchased online with a credit card are subject to the following fees per transaction: 7.9% (raffle management fee); $0.30 plus 2.9% (credit card processing fee).
- A physical ticket will be created for all purchases made online. The online ticket number you receive on your email receipt and the physical ticket number will not be the same. Physical tickets will be placed in the secure drum from which the winning entry will be selected. The winner will be determined by the name on the ticket, not the number.
- If you do not receive email confirmation of your online purchase within 24 hours, contact St. Peter at 719-481-3511.
The Drawing
- The winning ticket will be selected by a random drawing on the date of the raffle drawing. St. Peter Catholic Church will select the name of the potential winner of the prize from all eligible raffle tickets. All tickets have an equal chance to win. Ticket purchasers need not be present to win.
- Prize to be awarded: 2019 Ford F-150 Super Crew 4x4 XL Truck.
- St. Peter Catholic Church, with the approval of the Colorado Secretary of State in accordance to Applicable Law, may postpone, alter or cancel a drawing.
Prize Information

- The prize may not be awarded exactly as illustrated in promotional materials due to circumstances outside the reasonable control of St. Peter Catholic Church but will be of equivalent quality and value. St. Peter Catholic Church may provide a suitable alternative to the prize at any time with the approval of the Colorado Secretary of State in accordance with Applicable Law.
Prize Claim
- The prize must be accepted as awarded, unless otherwise stated in the Rules or as deemed necessary by St. Peter Catholic Church and upon approval of the Colorado Secretary of State.
- All prize winners must be eligible holders under the Terms and Conditions and Applicable Law. If a prize winner is found not to comply with the Terms and Conditions or Applicable Law, then the prize may be forfeited and retained by St. Peter Catholic Church.
- The prize will be awarded to the individual named on the winning ticket. The initial prize notification letter will be promptly sent to the prize winner by U.S. Mail and/or by email to the address shown in the Raffle database, as provided by the purchaser. Prize draw results will also be posted at petertherock/raffle.com.
- If the prize is not claimed within 20 calendar days of the applicable drawing date, the winner will be notified by U.S. Postal Service Certified Mail, return receipt requested. The notice will include information regarding the prize won, a contact person’s email and how the winner may claim the prize. If a winner fails to claim a prize within 30 calendar days of receiving the mail notification, St. Peter Catholic Church may retain the prize.
- A prize will not be awarded if either the purchaser or the holder is ineligible to purchase or hold the ticket under the Terms and Conditions or if they provided false or misleading information in connection with the ticket’s purchase. In this event, no additional drawing will be held and St. Peter Catholic Church will retain the prize won with the ticket.
Winners
- The odds of winning a prize depends on the number of valid raffle tickets sold. The chances of winning are based on the number of tickets sold.
- The prize will be awarded to only one (1) winner. If the ticket has more than one name on it, the prize will be awarded to the eligible individual whose name appears first on the ticket. That individual is solely responsible for allocating the value of the prize among the purchasers.
- Acceptance of a prize constitutes permission for St. Peter Catholic Church to use the winner’s name, picture, video image, and relevant quotes to promote the Upon This Rock campaign, and agreement by the winner that the prize will not be used for fundraising for another charity.
- The winner of the prize shall have no rights in or to the prize itself until the winner has been verified as eligible by St. Peter Catholic Church and until delivery of the prize to the winner has been completed. Until that time, as between St. Peter Catholic Church and the winner, the prize remains the sole property of St. Peter Catholic Church.
- In case of a winner accepting a truck he/she will take ownership subject to all applicable federal, state, and local fees.
- Verification of Potential Winner: THE WINNER IS SUBJECT TO VERIFICATION BY ST. PETER, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE RAFFLE. AN ENTRANT IS NOT A WINNER OF THE PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
Taxes/Prize restrictions
- Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein, including but not limited to, federal, state, license fees, registration fees and automobile insurance, are the responsibility solely of winner.
- The value of the prize is includible in the winner’s gross income, and may be subject to reporting by St. Peter to the Internal Revenue Service. The winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize. The winner assumes all fees, local, state and federal taxes. The winner of the truck raffle agrees that the value of the property reported by St. Peter Catholic Church for income tax and other purposes will be based on the written appraisal obtained by St. Peter Catholic Church from Phil Long Ford. St. Peter Catholic Church does not guarantee that a winner who receives the truck will be able to sell it for the appraisal value or that the Internal Revenue Service will use that value in its tax calculations.
- The winner of the vehicle in the St. Peter Catholic Church raffle is responsible for payment of applicable taxes, titling, and licensing fees prior to receiving the vehicle.
- St. Peter Catholic Church takes no responsibility for any tax liabilities. Winners should consult a tax professional.
